Assureal.com (“Assureal”), a KROCSIC SYSTEMS LLP company, is a platform provided to its users for the services offered. The platform provides listing space for the Professional service providers who can serve the client remotely using Assureal communication, platform & program management, dispute management, customer support and payment gateway. Assureal does not allow professionals to solicit clients
The following “Terms of Service”, govern access and use of the Assureal website, including any content, functionality and services offered on or through www.assureal.com (“Website”).
This Website shall only be accessed by users who are 18 years of age or older. By using this Website, user represents and warrants that he is of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If user does not meet all of these requirements, user must not access or use the Website.
For any questions regarding the Website or Terms of Service, User can contact the customer support team.
• “Professional” is a user who offers and performs services on Assureal Platform.
• “Client” is a user who purchases services on Assureal platform.
• “Service” is a service offered by Assureal to its clients.
• “Custom Orders” are requests made by a Client to receive a Custom Offer from a Professional.
• “Order”/”Orders” are the formal agreement between a Client and Professional after a request for Service is raised by the Client.
• “Order Page” is where Clients and Professionals communicate with each other in connection with an ordered Product.
• “Disputes” are disagreements experienced during an order between a Client and Professional.
• “Revenue” is the money Professionals earn from completed orders.
• “Delivered” when the product is received/ comes in possession of/ by the Client.
Only registered users may transact with Assureal. Registration is online on the Website and free.
Clients pay through Assureal’s payment gateway or through Cash on ordering in advance to create an order.
Services from the Professionals may be availed by Client either through Phone facility or through the Website
Services may be purchased using a Credit Card, Debit Card and Net Banking on Assureal. Other modes of Payments are not accepted and Payments made on other than Assureal platform are not valid.
Professionals must fulfil their orders, and may not cancel orders on a regular basis or without any cause. Cancelling orders will affect Professionals’ ratings and reputation.
Clients are granted all rights for the delivered Service, unless otherwise specified by the Professional.
If an order is cancelled (subject to cancellation policy), the amount paid will be refunded to the Client.
The Professional’s rating is calculated based on the order reviews posted by Clients on Products.
All the Services availed on Assureal are chosen by the Client and left to his/her discretion in making such decisions and the decision lies on the Client.
Services availed by the Client may be removed & legal action may be taken against such Clients by Assureal for violations to these Terms of Service, which may include (but are not limited to) the following violations and/or materials:
Illegal or Fraudulent services, Copyright Infringement, Trademark Infringement;
Copyright Infringement, Trademark Infringement reported through our Intellectual Property Claims Policy;
Adult oriented services, Pornographic, Inappropriate/Obscene;
Intentional copies of Products;
Spam, Nonsense, or Violent Products;
Services misleading to Clients, including violations of third party terms of service
Reselling of regulated goods
TECHNOLOGY USAGE FEE
Assureal considers itself as Software-as-a-Service (“SAAS”) providers. In consideration for the use of Assureal’s online platform and its communication, Service management and payment gateway, Assureal charges a technology usage fee.
Once payment is confirmed, Client Order will be created and given a unique order number.
Additional Services can be requested by the client by paying the amount quoted by the professional for the respective Services.
Once the requested Service is completed, the completed order is notified by the professional to the client about the status of the order.
After the order is delivered, if there are no request raised by the client within 3 days regarding the completed order then such orders are considered as Completed.
Assureal encourages Clients and Professionals to try and settle conflicts amongst themselves, if for any reason this fails; users can contact Assureal’s customer support team for assistance.
When a Client orders a Product, the Professional is notified by email as well as notifications on the Website while logged into the account.
Professionals are required to meet the delivery time they specified when creating their Products. Failing to do so will allow the Client to cancel the order when an order is marked as late and may harm the Professional’s rating upon discussing with team Assureal.
Professionals must send completed files and/or proof of work to the Client through the Assureal platform.
Clients are responsible for scanning any documents, soft copies, files for viruses and malware. Assureal will not be held responsible for any damages which might occur due to site usage, use of content or files transferred.
A Professional may cancel an order without the Client’s consent at any given moment (Force Cancellation). However, this will have a negative effect on the Professional’s rating.
Clients may use the “Request Modifications” feature located on the Order page while an Order is marked as Delivered if the Delivered materials do not match the Professional’s description on their Product page or the requirements sent to the Professional at the beginning of the order process.
Feedback reviews provided by Clients after the completion of Service are an essential part of Assureal’s rating system. Reviews reflect the Client’s overall experience with the Professionals and their service. Clients are encouraged to communicate to the Professional any concerns experienced during their active order in regards to the service provided by the Professional.
Leaving a Client’s feedback is a basic prerogative of a Client. Feedback reviews will not be removed unless there are clear violations to our Terms of Service.
To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate sales executed exclusively through the Assureal platform from users within our community. Purchases arranged, determined to artificially enhance Professional ratings, or to abuse the Assureal platform with purchases from additional accounts, will result in a permanent suspension of all related accounts. Any feedback which is against the law of the land will be taken seriously and required legal proceedings are executed against such users.
Feedback comments given by Clients are publicly displayed along with the respective professionals. Clients have the option not to include a comment, but still rate the service. Cancellation of an order does not remove feedback unless mutually agreed.
Withholding the delivery of services, files, or information required to complete the Product’s service with the intent to gain favourable reviews or additional services is prohibited.
Clients are allowed to provide the review on Services up to 30 days after an order is marked as complete. No new reviews may be added to an order after 30 days.
Most of the services on Assureal are delivered physically (documents etc.). For these types of Products, Professionals may decide to add shipping charges.
Clients who order Products that require physical delivery will be asked to provide a shipping address.
To give a seamless experience to our users Assureal has tied up with national and international reputed logistics vendors and provides a one-click pick up tool built into the order page (as applicable).
Assureal does not handle or guarantee shipping, tracking, quality, and condition of items or their delivery and shall not be responsible or liable for any damages or other problems resulting from shipping.
A tracking number is a great way to avoid disputes related to shipping. Assureal requires entering the tracking number if available in the order page when delivering the Product.
DISPUTES, CANCELLATION AND REFUND
Assureal encourages Clients and Professionals to try and settle conflicts amongst themselves. If for any reason this fails, users can contact Assureal’s customer support team for assistance.
Client can cancel the Order within 24 hours of placing the same through the website / Email to Assureal.
Order cancellations (when eligible) can be performed by customer support only up to a period of 24 hours from the date of Order. Assureal will not cancel orders after that time. Assureal will withhold 10% of the order value as order processing fee in case the Client opts to cancel the order within the stipulated time.
In case the Professional opts to cancel the order any time as he is unable to service the order, the full order value will be refunded to the Client. The Professional will be liable to pay Assureal the order processing fee.
Filing a transaction dispute or reversing a payment through payment provider or bank is a violation to these Terms of Service. Doing so may get user’s account temporarily disabled to investigate possible security violations. Note: once user has filed a dispute with payment provider, the funds will be ineligible for a refund due to our obligations towards the payment provider.
In the event of a dispute, Users encouraged to contact customer support team for a resolution.
Eligibility to cancel an order will be assessed by our customer support team based on a number of factors, including violations to Terms of Service, general misconduct, and improper usage of the Assureal delivery system.
Orders are not eligible to be cancelled based on the quality of service/materials delivered by the Professional if the Service was rendered as described. Clients may rate their experience with the Professional, including the overall level of service quality received.
Assureal reserves the right to cancel Orders or place funds on hold for any suspected fraudulent transactions made on the Website.
Assureal approved cancel requests will be processed within 7 working days to refund and credit the amount to the customer bank account.
This section relates to the expected conduct users should adhere to while interacting with each other on Assureal.
To protect our users’ privacy, user identities are kept anonymous. Requesting or providing email addresses, Skype/IM usernames, telephone numbers or any other personal contact details to communicate outside of Assureal in order to circumvent or abuse the Assureal messaging system or Assureal platform is not permitted.
Assureal does not provide any guarantee of the level of service offered to Clients.
Assureal does not provide protection for users who interact outside of the Assureal platform or that are actively violating our Terms of Service.
All information and file exchanges must be performed exclusively on Assureal’s platform.
Rude, abusive, improper language, or violent messages sent to users will not be tolerated and may result in an account warning or the suspension/removal of the account and legal proceedings may be executed against such cases.
Users may receive a warning to their account for violations of Terms of Service or any user misconduct reported to our Trust and Safety team. A warning will be sent to the user’s email address and will be displayed for such user on the Site. Warnings do not limit account activity, but can lead to permanent disable of the user’s on the severity of the violation.
Adult Services & Pornography – Assureal does not allow any exchange of adult oriented or pornographic materials and services.
Inappropriate Behaviour & Language – Communication on Assureal should be friendly, constructive, and Professional. Assureal condemns bullying, harassment, and hate speech towards others. Assureal allows users a medium for which messages are exchanged between individuals, a system to rate orders, and to engage on larger platforms such as our Community Forum and Social Media pages.
Phishing and Spam – Assureal takes the matter its members’ security seriously. Any attempts to publish or send malicious content with the intent to compromise another user’s account or computer environment are strictly prohibited. Please respect user’s privacy by not contacting them for commercial purposes without their consent.
Privacy & Identity User shall not publish or post other people’s private and confidential information. Any exchange of personal information required for the completion of a service must be provided in the order page. Professionals further confirm that whatever information they receive from the Client, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the work to the Client. Any users who engage and communicate off of Assureal will not be protected by Terms of Service.
Intellectual Property Claims – Assureal will respond to clear and complete notices of alleged copyright or trademark infringement
Fraud / Unlawful Use – User shall not use Assureal for any unlawful purposes or to conduct illegal activities.
Multiple Accounts – To prevent fraud and abuse, users are limited to one active account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the Assureal community will be disabled. Mass account creation may result in disabling of all related accounts. Note: Any violation to Terms of Service is cause for permanent suspension of all accounts.
Targeted Abuse – Assureal shall not tolerate users who engage in targeted abuse or harassment towards other users on Assureal. This includes creating new multiple accounts to harass members through our message or ordering system.
Selling Accounts – User shall not buy or sell Assureal accounts.
Assureal reserves the right to put any account on hold or permanently disable accounts due to breach of the Terms of Service or due to any illegal or inappropriate use of the Website or Services.
Violation of Assureal’s Terms of Service may get user’s account disabled permanently.
Users with disabled accounts will not be able to sell or buy on Assureal.
Users who have violated our Terms of Service and had their account disabled may contact customer support team for more information surrounding the violation and status of the account.
Users must be able to verify the account ownership through customer support by providing materials that prove ownership of that account.
Assureal may make changes to its Terms of Service from time to time. When these changes are made, Assureal will make a new copy of the terms of service available on this page.
User agrees that if user access Assureal after the date on which the Terms of Service have changed, it would be treated as user has accepted the updated Terms of Service.
Upon realization of the payment to the Professional through Assureal, the Service will be taken up as Order by the professionals and a notification is sent to Client’s declared mobile number or Email ID.
Any other Services other than the agreed services upon payment done at the time of availing the Services are considered final and any other requests will be charged separately by the professional.
The opinions formed by the professional will be based on the documents provided by the Client only. Further, any requests made by the professional for any required or missing document shall be dealt between the professional and the client. Assureal shall not be responsible for generating or providing any document as part of Client or professional.
The Service will be delivered to the Client within the stipulated time agreed upon during the choosing of Service by the Client. However due to unforeseen circumstances like strikes, bandh’s, due to acts of God, acts of government, floods, fires, earthquakes, civil unrest, acts of terror, strikes or other labour problems, the Service deliver may get postponed.
Assureal shall not be liable for any downtime or delay or unavailability of the Website caused by circumstances beyond Assureal’s reasonable control, including without limitation, acts of God, acts of government, floods, fires, earthquakes, civil unrest, acts of terror, strikes or other labour problems, internet service provider failures or delays, or denial of service attacks.
CLIENT/PROFESSIONAL MATERIAL CONTENT
Client/Professional Material Content refers to the content added by clients and professionals. Assureal does not check user uploaded/created content for appropriateness, violations of copyright, trademarks, other rights or violations. We invite everyone to report violations together with proof of ownership as appropriate. Reported violating content may be removed or disabled.
Assureal is not responsible for the content, quality or the level of service provided by the Professionals. Assureal provides no warranty with respect to the Products, their delivery, and any communications between Clients and Professionals. Assureal encourages users to take advantage of the rating system, community and common sense in choosing appropriate Service offers.
For specific terms related to Intellectual Property rights and for reporting claims of copyright infringement or trademark infringement – please see Intellectual Property Claims Policy which forms an integral part of these Terms of Service. Note that it is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers.
Ownership and limitations: Unless clearly stated otherwise, when the work is delivered, and subject to payment, the Client is granted all intellectual property rights, including but not limited to, copyrights for the work delivered from the Professional, and the Professional waives any and all moral rights therein. The delivered work shall be considered work-for-hire. All transfer and assignment of intellectual property to Client shall be subject to full payment for the Product/Service and the delivery may not be used if payment is cancelled for any reason. For removal of doubt, in custom created work (such as art work, design work, report generation etc.), the delivered work shall be the exclusive property of Client, and Professional assigns all rights, title and interest in the delivered work. Note: Some Services charge additional payments for commercial use.
Professionals further confirm that whatever information they receive from the Client, which is not public domain, shall be kept confidential and shall not be shared or used for any purpose whatsoever other than for the delivery of the ordered work to the Client.
DISCLAIMER OF WARRANTIES
Use of the Website, its content and any services or items obtained through the website is at user’s own risk. The Website, its content and any services or items obtained through the Website are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. Neither Assureal nor any person associated with Assureal makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy or availability of the Website.
The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.
LIMITATION ON LIABILITY
In no event Assureal, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with the use, or inability to use, the website, any websites linked to it, any content on the Website or such other websites or any services or items obtained through the Website or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
The foregoing does not affect any liability which cannot be excluded or limited under applicable law.
WE WILL NOT BE LIABLE FOR ANY INFORMATION, SOFTWARE, OR LINKS FOUND AT ANY OTHER WEBSITE, INTERNET LOCATION, OR SOURCE OF INFORMATION, NOR FOR YOUR USE OF SUCH INFORMATION, SOFTWARE OR LINKS, NOR FOR THE ACTS OR OMISSIONS OF ANY SUCH WEBSITES OR THEIR RESPECTIVE OPERATORS.
Certain of the names, logos, and other materials displayed on the Site or in the Services may constitute trademarks, trade names, service marks or logos (“Marks“) of Assureal or other entities. You are not authorized to use any such Marks without the express written permission of Assureal. Ownership of all such Marks and the goodwill associated therewith remains with us or those other entities.
You may deactivate your Account and end your registration at any time, for any reason by sending an email to firstname.lastname@example.org. Assureal may suspend or terminate your use of the Site, your Account and/or registration for any reason at any time. Subject to applicable law, Assureal reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Site pursuant to its internal record retention and/or content destruction policies. After such termination, Assureal will have no further obligation to provide the Services, except to the extent we are obligated to provide you access to your health records or Treating Providers are required to provide you with continuing care under their applicable legal, ethical and professional obligations to you.
Right to modify
Any dispute, claim or controversy arising out of or relating to this notice or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this Agreement to arbitrate, or to Your use of the Website or its features or the information to which it gives access, shall be determined by arbitration in India, The venue of such arbitration shall be Bangalore, India. The governing law of the Agreement shall be the substantive law of India. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the Parties .
The Parties shall have the right to apply to a court of competent jurisdiction to obtain interim injunctive relief in respect of any dispute, pending resolution of such dispute in accordance with the Agreement.
Notices: All notices and other communications required or permitted hereunder to be given to a Party shall be in writing, in the English language, and shall be sent by facsimile, e-mail, or mailed by prepaid internationally-recognized courier, or otherwise delivered by hand or by messenger, addressed to such Party’s address as set forth below or at such other address as the Party shall have furnished to the other Party in writing in accordance with this provision:

Waiver: No term of the Agreement shall be deemed waived and no breach excused, unless such waiver or consent shall be in writing and signed by the Party claimed to have waived or consented. Any consent by any Party to, or waiver of a breach by the other, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
